These Terms & Conditions ("Terms") govern the provision of repair services by Fix Moi ("we", "us", or "our") to you, the customer ("you" or "customer"). By submitting your electronic device ("Device") to Fix Moi for repair, you agree to be bound by these Terms. Please read them carefully.

1. Diagnosis & Estimates

1.1. Diagnosis Fee:
- A diagnosis fee of $80.00 CAD will be charged for all devices submitted for assessment.
- This fee covers the time and expertise required to diagnose the Device's issue(s).
- This diagnosis fee is waived if you proceed with the recommended repair.
- This fee is non-refundable if you decline the repair quote. In such cases, if you choose not to accept the quote, Fix Moi reserves the right to keep the Device for parts to offset the diagnosis cost. You will be informed of this policy prior to diagnosis.
1.2. Repair Estimate:
- For repairs estimated at $80.00 CAD or more, Fix Moi will provide a written estimate of the total repair costs, as required by the Office de la protection du consommateur (OPC).
- This estimate will include the nature of the repair, the total price of the repair, Fix Moi's details, a description of the Device, and the date of the estimate.
- Our quotes are normally firm. In rare instances, if further issues are discovered during the repair that significantly change the scope or cost, Fix Moi will contact you for re-approval before proceeding with any additional work.
- If the estimated repair costs exceed the fair market value of the Device, Fix Moi will advise you against proceeding with the repair, unless the purpose is for data recovery, which is subject to separate data recovery pricing and terms.

2. Repair Authorization & Process

2.1. Authorization:
- You authorize Fix Moi to perform the necessary diagnostic and repair services on your Device as agreed upon in the estimate. We will proceed only after we have received your explicit approval on the quote, which may be provided via phone call, message, or email.
2.2. Customer-Supplied Parts:
- Fix Moi allows customers to supply their own parts for repair. However, Fix Moi provides no warranty whatsoever on parts supplied by the customer, nor on the labor performed for the installation of such parts. Any issues arising from the quality, compatibility, or performance of customer-supplied parts, even after successful installation by Fix Moi, will not be covered under Fix Moi's warranty.
2.3. Turnaround Time:
- Repair times provided are estimates only. While we strive for efficient service, delays may occur due to unforeseen technical issues, parts availability, or high demand. We will keep you informed of any significant changes to the estimated timeline via phone, message, or email.
2.4. Pre-Existing Conditions:
- When you submit your Device, we conduct an initial assessment. Sometimes, there are pre-existing problems or conditions with the Device that may not be immediately apparent or that may worsen during the repair process. These will be communicated to you only after your Device has been received and further inspected. If additional repair is needed or desired due to such conditions, we will communicate with you and obtain your approval before continuing any further work. Fix Moi is not responsible for the worsening of pre-existing conditions unrelated to the repair service requested.

3. Data Loss Disclaimer & Privacy

3.1. Data Loss:
- While Fix Moi takes reasonable precautions during repair, any repair process, including diagnostic procedures, carries an inherent risk of data loss. Fix Moi explicitly disclaims all liability for any loss, corruption, or compromise of data, programs, or files stored on your Device, whether direct or indirect.
- We strongly recommend that you back up all data, software, information, and files stored on your Device before submitting it for repair.
3.2. Privacy:
- Your privacy is a top priority at Fix Moi. Our technicians and the repair areas are under surveillance to ensure security and accountability. No data from your device will be shared with anyone other than you, the client. Technicians will only access necessary functions of your Device for diagnosis and repair and will not copy, share, or misuse your personal data. All data accessed will be handled in strict accordance with our Privacy Policy (link to your Privacy Policy page here).

4. Repair Warranty

4.1. Quebec Legal Warranty:
- As per Quebec's Consumer Protection Act, all repairs performed by Fix Moi (including both parts and labor) are guaranteed for a minimum period of three (3) months from the date the repaired Device is ready for collection. If the same fault re-occurs within this 3-month period, Fix Moi will re-repair the Device free of charge.
4.2. Fix Moi Commercial Warranty:
- In addition to the legal warranty, Fix Moi offers varying warranty periods depending on the quality of parts chosen:
- Aftermarket Parts (Cheapest Quality): No warranty on parts or labor.
- Original from Manufacturer Parts: 90 days warranty on parts, with no labor warranty.
- Premium from Our In-House Supplier Parts: 1 year warranty on parts only, and 15 days warranty on labor.
- The specific warranty applicable to your repair will be clearly stated on your invoice.
4.3. Warranty Coverage:
- The warranty covers only the parts installed by Fix Moi (based on the chosen quality level) and the labor directly related to the original repair issue for the specified period.
4.4. Warranty Exclusions:
The repair warranty (both legal and commercial, if applicable) does NOT cover:
- New physical damage (e.g., drops, impacts, liquid spills, pressure points) occurring after the original repair.
- Liquid damage or exposure occurring after the original repair.
- Tampering or unauthorized repair attempts by anyone other than Fix Moi after the original repair.
- Software issues, virus infections, or data loss unrelated to the hardware repair performed.
- Battery degradation over time, as batteries are consumable components.
- Damage caused by incompatible or non-recommended accessories.
- Any issues caused by components or conditions not directly related to the original repair performed by Fix Moi.
- Aesthetic damage that does not affect functionality.
4.5. Warranty Claim Process:
- To make a warranty claim, you must return the Device to Fix Moi along with your original repair ticket/receipt. Fix Moi will re-diagnose the Device to determine if the issue falls under warranty.
4.6. No Fix, No Fee Policy:
- Fix Moi is a specialized repair store. Our business model involves a diagnosis fee as per Section 1.1, and therefore a "no fix, no fee" policy does not apply to our services.

5. Uncollected Devices

5.1. Notification:
- Fix Moi will notify you when your Device's repair is complete and ready for pickup (or deemed unrepairable) via phone call, message, or email to the contact information you provided.
5.2. Abandonment After 30 Days:
- If we do not receive a reply or approval on the quote, or if the Device is not picked up after 30 calendar days from the date of our first notification that the Device is ready for pickup or that the quote requires approval, the Device will be considered abandoned and will become the property of Fix Moi.
5.3. Storage Fees:
- If you wish to recover your Device after it has become the property of Fix Moi (i.e., after 30 days from first notification), a $50.00 CAD storage fee will apply, in addition to any outstanding repair or diagnosis fees. This recovery is subject to the Device still being available.
5.4. Disposal of Unclaimed Items:
- Unclaimed devices that become the property of Fix Moi will be recycled or used for parts. Prior to disposal or repurposing, all client data on the Device will be securely erased or physically destroyed to protect your privacy. This action is done without further obligation or notification to you.
- Fix Moi will also adhere to the notification and remittance requirements of Quebec's Loi sur les biens non réclamés (Unclaimed Property Act) for devices that remain unclaimed for the statutory periods, particularly for higher-value items.

6. Limitation of Liability

6.1. Damage During Repair:
- In the unlikely event that your Device is damaged while in Fix Moi's possession, and such damage is directly attributable to Fix Moi's negligence, our liability will be limited to either:
- The cost of repairing the new damage, OR
- The fair market value of the Device immediately prior to the new damage occurring, whichever is less.
- Fix Moi is not liable for existing defects or conditions that may exacerbate during the repair process, as detailed in Section 2.4.
6.2. Indirect/Consequential Damages:
- Fix Moi is not liable for any indirect, incidental, special, or consequential damages arising from our repair services, including but not limited to lost profits, lost data, loss of use, or business interruption, regardless of whether Fix Moi was advised of the possibility of such damages. This limitation is not on Fix Moi but on the scope of damages for which Fix Moi can be held responsible.

7. Refusal of Service

Fix Moi reserves the right to refuse service to any customer or Device at its sole discretion, including but not limited to:
- Devices suspected of being involved in illegal activity.
- Devices posing a safety risk to technicians or the premises.
- Customers engaging in abusive, threatening, or uncooperative behavior.
- Devices with severe, irreparable damage.

8. Governing Law & Dispute Resolution

8.1. Governing Law:
- These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein.
8.2. Dispute Resolution:
- In the event of a dispute arising from these Terms or our services, we encourage you to first contact Fix Moi management directly to seek an amicable resolution through direct negotiation. If a resolution cannot be reached, mediation can be considered as an alternative dispute resolution method. If neither direct negotiation nor mediation leads to a satisfactory outcome, then small claims court is the final recourse. You also retain the right to file a complaint with the Office de la protection du consommateur (OPC) or pursue other legal remedies available under Quebec law.

By submitting your Device for repair, you acknowledge that you have read, understood, and agree to these Fix Moi Repair Terms & Conditions.
